California considers someone to be driving while impaired when their BAC is 0.08 or higher. Note that you don’t have to have a BAC that high to be arrested for driving while impaired. Penalties vary, depending on how many DUI convictions you have and other factors. California law is most lenient on first-time offenders, but considerably harsher on those who are arrested for DUI within 10 years of the first arrest. The penalties are even higher for a third-time offender. You could face time in jail, fines of several thousand dollars, the loss of your license, probation, and an interlock device on your vehicle after a DUI conviction.
